MOUND CITY – Court proceedings in the case against a rural Pleasanton couple accused of growing and harvesting marijuana for the purposes of distribution will remain in district court here in Linn County.

According to Linn County Sheriff Barry Walker, a grand jury was not convened on the case because the U.S. Attorney General’s office did not choose it as a case to be presented.

"Their office told us that the case was not chosen to go before the grand jury because of the way the search warrant in the case was written," explained Sheriff Walker.

Sheriff Walker went on to note that though the search warrant was completely legal and in fact was the basis for another warrant later issued in the same case by state agencies, it was written concisely, as preferred by local judges, and did not contain the "fluff" that is preferred at the federal level.

Sheriff Walker further noted that a representative of the U.S. Attorney General’s office will be coming to Linn County at a future date to give the officers tips on how to write warrants in future cases that they believe may have the potential of being prosecuted at the federal level.
